What is Mediation?
It is a process to bring about a
peaceful settlement or compromise
between disputants through the objective
intervention of a neutral party.
Most court cases are settled before
they even go to court and mediation has
its advantages.
-It is less expensive in most
cases.
-It is quicker. The process can occur
in hours instead of years in a court.
In mediation, the parties resolve the dispute
together and both have a say in the final
resolution, whereas, in a court case, a judge could rule
either way.
-The process is less formal and as a
result less stressful.
-Our court system is an
adversarial system. There must be
a loser and all points must be
challenged even at the expense of a
person's reputation or emotions. In
mediation, the process can be private
and it is designed not to destroy
relationships, but to enable the parties to
resolve their differences together.
The fees are designed to encourage
resolution. More cooperation between
parties will result in lower costs for
them.
